Terms and Conditions

Customer acceptance of Terms and Conditions

Upon authorisation from the customer to provision services, it is assumed that the customer has read and accepted all of the Terms and Conditions listed below. Any concerns regarding these Terms and Conditions can be raised by contacting us during business hours.

Service Length

All services are invoiced following the account setup. For new clients, payment for licenses and domain names is required in advance unless specified otherwise at the time of sign up. Payment can be made via electronic funds transfer (EFT) or cheque as per the details on the invoice.

The following service lengths apply to our services:

  • Shared Hosting - annually
  • Business Email/MailTransact - choice of quarterly, half-yearly or annually
  • Managed Applications - choice of quarterly, half-yearly or annually
  • Virtual Dedicated Servers - choice of quarterly, half-yearly or annually
  • Mail Backup & DNS Hosting - annually
  • MDC - As per agreement at the time of sign up

Privacy Policy

Client privacy is regarded highly at Webres Solutions. Your private information will only be used for billing purposes. Third parties may require private information for the purposes of domain registrations, licensing and warranties. In this instance, your expressed permission will be sought prior to disclosure.

Uptime guarantee and SLA

Our uptime guarantee aims to deliver 99.9% uptime or above each month for our hosting and networking infrastructure. The target for customers on our high availability services is 99.99% uptime per month and credits are provided if this service level is not met each month as agreed and specified in the contract. SLA uptime is measured using a third party uptime monitoring service with checks at 2 minute intervals from multiple locations.

Scheduled outages for the maintenance of application, server or networking infrastructure is not included under the uptime guarantee or SLA. Notification will be provided to customers 7 days prior to a standard scheduled outage and 48 hours for an emergency (critical) scheduled outage.

Service Cancellation

A hosting service may be cancelled or suspended with or without notice if the account owner breaches any of the conditions:

  • Using a service to host adult or illegal material
  • Using a service for the purpose of sending out SPAM email
  • Using a service with malicious intent or to launch an attack on other systems
  • Exceeding the system resources (by greater than 10%) on our shared platform as deemed by our systems administrator as a result of incorrect site configuration, site security breach or rogue processes.

The customer is not entitled to any refund, whether in part or the full amount of fees paid, with the exception of credits as a direct result of a breach of an SLA between the customer and Webres Solutions.

Limitations of damages

Recovery of damages from Webres Solutions may not exceed the amount of fees it has collected for the month. Webres Solutions accepts no responsibility and is not liable for any losses incurred by the customer as a direct or indirect result of Webres Solution's actions or services provided.

  • These terms and conditions are subject to change without notice.
  • Within these terms and conditions, any reference to 'Our' refers to Webres Solutions as a trading entity.
